Nothing in these Terms affects any statutory rights that you may have as a consumer.

2. Definitions
“Customer”, “you” or “your” means the person or organisation requesting or purchasing our services. “LM Logistics”, “we”, “us” or “our” means Lloyd Michmarck Logistics Ltd trading as LM Logistics. “Services” means the Man & Van, removals, delivery, collection, transportation, loading, unloading or related services agreed in your booking. “Booking” means an accepted agreement between you and LM Logistics. “Goods” means items we agree to handle, collect, transport or deliver.
3. Our Services
Subject to availability and individual agreement, services may include Man & Van; house and flat moves; student moves; furniture and appliance collection/delivery; store and marketplace collections; local and longer-distance deliveries; loading and unloading; small business deliveries; and other agreed light logistics services. The precise services are those specified in the written quotation or booking confirmation.
4. Quotations
Quotations are based on information you provide. You must accurately disclose collection and delivery addresses; quantity and nature of goods; size and weight of unusually large or heavy goods; property type; floors, stairs and lifts; carrying distance; parking and loading restrictions; dismantling or assembly; number of people required; preferred date and time; and circumstances affecting the work. Unless stated otherwise, a quotation is an estimate subject to availability and confirmation. We may revise it before or during a job if information was materially incomplete or inaccurate, or circumstances outside the original scope increase the work. We will explain material additional charges where reasonably practicable before doing the additional work.
5. Booking and Formation of Contract
Submitting an online quotation form or enquiry does not itself confirm a booking. A booking becomes binding when we accept the job and agree the material details, including services, price or pricing basis, date and any required deposit. Confirmation may be by email, text, WhatsApp or another agreed durable form.
6. Prices
Prices may be hourly, fixed, distance-based, based on the size or nature of the job, or another agreed method. Additional charges may reasonably arise for additional labour or time; substantial waiting caused by the customer or third parties; additional collection/delivery points or goods; materially incorrect inventory; undisclosed difficult access; unusual or excessively heavy items; agreed or reasonably incurred parking, tolls, congestion or journey-specific charges; and work outside the original scope. We will not impose hidden charges and will make the pricing basis clear before confirmation.
7. Minimum Booking Period
Any hourly minimum will be stated in the quotation or pricing information before booking confirmation. After the minimum, additional time may be charged in increments disclosed before booking.
8. Deposits
We may require a deposit to secure a booking. The amount, payment date and cancellation/refund conditions will be communicated before payment. A deposit is not automatically non-refundable; any amount retained is subject to these Terms, applicable consumer law and the circumstances.
9. Payment
Unless agreed otherwise in writing, payment is due at the time stated in the booking confirmation or invoice, must use an accepted method, and the customer remains responsible for authorised additional charges. Business customers may receive separate invoicing terms by written agreement. We reserve statutory rights regarding overdue payments.
10. Customer’s Right to Cancel
Consumers entering a distance or off-premises contract may have a statutory right to cancel within 14 days without giving a reason, subject to exceptions and rules. If you request services to begin during this period, we may ask for an express request for early performance. If you cancel after requesting an early start, you may, where permitted by law, have to pay an amount proportionate to services properly supplied. Where services are fully performed during the cancellation period following the required request and acknowledgement, the statutory cancellation right may cease as provided by law. Nothing in our commercial policy removes applicable statutory rights. To cancel, clearly contact info@lmlogistics.co.uk or +44 7516 762121.
11. Our Commercial Cancellation and Rescheduling Policy
Outside statutory cancellation rights, the cancellation or rescheduling policy will be disclosed during booking. Reasonable charges may apply to late cancellations where we suffer loss because vehicles, personnel and time were reserved. Charges will be fair and proportionate, taking account of notice, work performed, costs incurred, likelihood of filling the slot and resulting losses. We will not seek more than reasonable loss or impose a penalty contrary to consumer law.
12. Changes to a Booking
Tell us as soon as possible about changes to date/time, collection or delivery address, inventory, property/access details, number of stops, personnel or scope. Changes depend on availability and may affect price; substantial changes may require a revised quotation.
13. Customer Responsibilities
- provide complete and accurate booking information;
- have authority to move the goods;
- ensure lawful and reasonably safe access;
- arrange necessary parking permits or disclose restrictions where agreed;
- pack goods appropriately unless packing is agreed as part of our service;
- identify fragile, valuable, unusually heavy or hazardous goods;
- secure personal documents, money, jewellery and other high-value items;
- ensure appliances are safely disconnected and prepared unless otherwise agreed;
- ensure the property is ready at the agreed time; and
- be present or arrange an authorised representative where reasonably necessary.
14. Goods We May Refuse to Carry
Unless expressly agreed in writing and lawful to transport, we may refuse illegal goods; dangerous, explosive or highly flammable materials; firearms or weapons; controlled drugs; hazardous chemicals; gas cylinders; live animals; perishable goods needing specialist conditions; cash, negotiable instruments or unusually high-value items; items that cannot safely be moved with agreed equipment/personnel; or goods whose transport would breach law, insurance requirements or reasonable health and safety standards.
15. Packing
Where the customer packs goods, they are responsible for reasonably suitable packaging. Fragile goods should be wrapped, protected and identified. Inadequate customer packing may be relevant when determining responsibility for damage. Where we provide packing as an agreed service, we will perform it with reasonable care and skill.
16. Access, Parking and Property Conditions
Disclose relevant access difficulties before booking where possible, including restricted parking, long carrying distances, narrow stairs, lack of lifts, height restrictions, restricted loading times and unusually difficult access. Parking charges, tolls and location-specific costs follow the agreed quotation or booking terms. We may decline work posing unreasonable health or safety risks to people, vehicles, goods or property.
17. Waiting Time and Delays
We will take reasonable care to attend within the agreed timeframe, but arrival and completion times may be estimates unless guaranteed. Delays may result from traffic, road closures, accidents, severe weather, breakdowns, emergencies, authority restrictions or earlier customers/third parties. We will take reasonable steps to keep you informed of significant delays. Nothing here excludes liability where unlawful.
18. Our Standard of Service
We will perform services with reasonable care and skill. Consumers have statutory rights for services not performed with reasonable care and skill or otherwise failing to comply with consumer law. Nothing in these Terms excludes or restricts those rights.
19. Loss or Damage
Inspect goods and relevant property as soon as reasonably practicable after completion. If you believe goods or property were lost or damaged while under our responsibility, notify us as soon as reasonably possible and provide booking details, a description, photographs where available, evidence of ownership/value where relevant and other information reasonably required. Prompt notice assists investigation but does not impose an artificial deadline removing statutory rights.
20. Liability
Nothing in these Terms excludes or limits liability where unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or statutory consumer rights that cannot lawfully be excluded. Subject to law, responsibility for loss or damage depends on the circumstances, including whether reasonable care and skill were exercised and whether the customer contributed through inadequate packing, inaccurate information or another act or omission. Insurance compensation is subject to policy wording, exclusions and limits.
21. Insurance
Where stated as active, we maintain insurance appropriate to our business activities, which may include Goods in Transit and/or Public Liability insurance. Insurance is subject to the insurer’s policy terms, exclusions, conditions and limits. Tell us before booking about particularly valuable or unusual goods so we can determine whether they can be carried and whether special arrangements are needed. We will not describe the business as “fully insured” unless relevant policies are active and apply to the advertised services.
22. Damage to Customer Property
We will take reasonable care when moving goods through homes and other premises. Notify us in advance of vulnerable flooring, walls, fixtures, narrow access or other circumstances needing special precautions. Where damage is alleged, both parties should preserve evidence and minimise further loss.
23. Third-Party Collections and Deliveries
Where goods are collected from or delivered to another person, retailer, marketplace seller, storage provider or business, you must provide accurate contact and collection/delivery information and ensure the other party is expecting us where appropriate. We are not responsible for the quality, condition, description or suitability of third-party goods merely because we collect or deliver them.
24. Failed Collection or Delivery
Reasonable additional charges may arise where a collection or delivery cannot be completed because nobody authorised is available, access is unavailable, goods are not ready, supplied information is materially incorrect or another customer-attributable circumstance prevents completion. Where possible, we will discuss alternatives before incurring material additional costs.
25. Complaints
We want to resolve concerns fairly. Contact info@lmlogistics.co.uk or +44 7516 762121. Include your name, booking reference if applicable, complaint details and relevant photographs or supporting information. We will acknowledge and investigate within a reasonable period. Raise issues promptly, particularly where inspection of alleged damage may be required. This procedure does not affect statutory rights.
26. Website Information
We take reasonable care to keep website information accurate. “From” prices, examples, estimated journey times and general descriptions are indicative unless included in a confirmed booking. Website availability does not guarantee a vehicle, crew or particular booking time.
27. Personal Information
We process personal information in accordance with our Privacy Policy available on our website.
28. Events Outside Our Reasonable Control
Neither party is responsible for failure or delay caused by an event outside that party’s reasonable control to the extent permitted by law. If such an event materially affects a booking, we will take reasonable steps to minimise disruption and discuss rescheduling, cancellation or other reasonable options.
29. Business Customers
If services are booked wholly or mainly for business purposes, additional or alternative commercial terms may be agreed in writing. Consumer protections in these Terms apply only where the customer meets the legal definition of a consumer.
30. Changes to These Terms
We may amend these Terms from time to time. Terms applicable to a confirmed booking will normally be those provided or made available when the booking was entered into, unless a change is required by law or separately agreed.
31. Severability
If any provision is unlawful or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
32. No Waiver
If we do not immediately enforce a right under these Terms, this does not necessarily mean that we have waived that right.
33. Third-Party Rights
Except where expressly stated otherwise, a person who is not a party to the contract has no right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.
34. Governing Law and Jurisdiction
These Terms and any dispute or claim arising from them are governed by the law of England and Wales. Consumers retain any mandatory rights regarding where proceedings may be brought.
